Two approaches to medical malpractice litigation

The divergent approaches to errors made in the health care industry are evident in two stories. In the first story, a woman entered a hospital for a routine hysterectomy, fully expecting to be released the following day.Instead, a series of medical errors resulted in her spending weeks in a coma, undergoing five operations and being left with permanent injuries. When she asked her doctor and hospital staff for an explanation of what went wrong, she was met with silence. 

Saving Lives, Saving Costs Act

Earlier last month, United States Representatives Andy Barr of Kentucky and Ami Bera, MD, of California introduced legislation they entitled "Saving Lives, Saving Costs Act." Supporters of this measure have packaged it as a tool to protect patient safety. In fact, the proposed law is nothing more than a thinly veiled attempt to prevent Georgia residents from using the Georgia court system to seek damages when injured as a result of medical malpractice. The proposed legislation would also allow the medical community to act as the ultimate fox guarding the hen house.

Elder Abuse

Recent reports indicate that elder abuse in nursing homes and other long-term care facilities throughout our Georgia communities has become a shockingly common problem. The United States Administration on Aging estimates that at least 10% of older Americans, constituting over 5 million individuals, experience abuse each year, with many of those individuals experiencing multiple forms of abuse. Unfortunately studies indicate that less than 1 in 14 cases of abuse are reported to authorities or prosecuted civilly or criminally in the courts.

Medical Mistakes - The Sixth Leading Cause of Death in America

The Wall Street Journal recently published an article noting the prevalence of medical mistakes in US hospitals and the devastating impact of those mistakes on innocent people. Estimates indicate that medical mistakes alone cause enough deaths to fill four jumbo jets every week making them the sixth leading cause of death in America. However, these numbers don't even begin to scratch the surface of the number of innocent people who are injured as a result of those mistakes and other medical malpractice. As the Wall Street Journal notes, "roughly a quarter of all hospitalized patients will be harmed by a medical error of some kind."
